What this Warranty Covers.

Chicagolands Goose Busters, Inc. agrees to provide a limited warranty to the holder of a valid proof of purchase (“Consumer” or “you”) that The Denier ™ device contained in this package (“Product”) is free from material defects in material and workmanship, subject to exclusion noted below.  This limited warranty extends only to the Consumer for Products purchased and used in the United States of America.

What Chicagolands Goose Busters, Inc. Will Do.

During the warranty period, Chicagolands Goose Busters, Inc. will repair or replace, at its option, without charge, a Product which is found to be materially defective in materials or workmanship and returned to Chicagolands Goose Busters, Inc..  Chicagolands Goose Busters Inc., at its option, may replace the Product with a new or refurbished product having the same or similar function.  If no defect is identified, then the Product will be returned to you COD.  Chicagolands Goose Busters, Inc may use new or equivalent to new parts to repair your Product.

How Long this Warranty Lasts.

This limited warranty shall expire two (2) years from the date of Product purchase or lease to own.  Replacement or refurbished parts and products are warranted for the original Product warranty period.  This warranty terminates if you sell or transfer your Product.

What this Warranty Excludes.

This limited warranty does not cover: (a) the cost of shipping and handling for returned and replacement products, or damage or loss during shipment for warranty service; or (b) any Product that has been subjected to misuse, abuse, damage, vandalism, negligence, accident, shipping or other physical damage, improper installation, abnormal operation or handling that is contrary to operation instructions, neglect, usage of alkaline batteries, acts of god, inundation, fire, water or other liquid intrusion, or force major; or (c) any Product that has been damaged due to repair, alteration, or modification by anyone other than an authorized service representative of Chicagolands Goose Busters, Inc.; or (d) any Product to the extent that whose identifying information has been removed, altered or rendered illegible; or (e) any Product purchased, used, serviced, or shipped for repair from outside the United States, or that is returned without a valid proof of purchase; or (f) any indirect or consequential harm caused as a result of any defect or failure of the Product to properly operate; or (g) paint applied to the Product; or (h) rechargeable batteries beyond 1 year.

How to Get Warranty Service.

To obtain warranty service, call 1-800-252-2276 to be assigned a Return Authorization Number.  We will provide you with detailed information, including instruction on how and where to return your Product and any applicable costs associated with a repair, replacement or exchange.  You may be required to provide proof of purchase before obtaining warranty service, and it is your sole responsibility to maintain such proof (e.g. a sales receipt/invoice).  Returned products that are determined not to be materially defective will be subject to a handling fee.  If you disagree with any of our decisions with respect to warranty service, you the right to contest that decision as permitted under applicable laws and regulations.
 
Chicagolands Goose Busters, Inc., at its own discretion, will perform any and all necessary modifications to existing units, including the removal of any feature(s) determined by Chicagolands Goose Busters, Inc., to be obsolete or ineffective, to all units which are sent in for servicing.
 

How State Law Applies.

This limited warranty gives you specific legal rights.  You may also have other rights which vary from state to state.

Limitation on Liability.

THIS WARRANY IS THE COMPLETE AND EXLUSIVE WARRANTY AGREEMENT FOR THE PRODUCT BETWEEN YOU AND CHICAGOLANDS GOOSE BUSTERS, INC..  NO ONE IS AUTHORIZED TO MAKE MODIFICATIONS TO THIS LIMITED WARRANTY AND YOU SHOULD NOT RELAY ON ANY SUCH MODIFICATION.  CHICAGOLANDS GOOSE BUSTERS, INC. RESERVES THE RIGHT TO CHANGE ITS LIMITED WARRANTY WITHOUT PRIOR NOTICE FOR FUTURE SALES.  CHICAGOLANDS GOOSE BUSTERS, INC. DISCLAMES ALL OTHER WARRANTIES WITH RESPECT TO ITS PRODUCTS, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, COURSE OF DEALING, TRADE USAGE OR PRACTICE OR THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGMENT OF THIRD PARTY RIGHTS.  MOREOVER, CHICAGOLANDS GOOSE BUSTERS, INC. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGEAS OF ANY NATURE ARISING OUT OF, OR IN CONNECTION WITH, THE LIMITED WARRANTY OF THE USE OR PERFORMANCE OF ANY PRODUCT, WHETHER BASD ON CONTRACT OR TORT, INCLUDING NEGLIGENCE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  THE TOTAL AGGREGATE LIABILITY BY CHICAGOLANDS GOOSE BUSTERS, INC. FOR DAMAGES OF ANY NATURE, REGARDLESS OF FORM, ACTION OR FORESEEABILITY, SHALL IN NO EVENT EXCEED THE AMOUNT PAID BY YOU TO US, FOR THE PRODUCT UPON WHICH LIABILITY IS BASED.  SOME STATES AND/OR COUNTRIES DO NO ALLOW LIMITATION ON HOW LONG AN IMPLED WARRANTY LASTS, AND/OR DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND/OR EXCLUSIONS MAY NOT APPLY TO YOU.  IF SUCH IS THE CASE, TO THE EXTENT PERMITTED BY APPLICABLE LAW, CHICAGOLANDS GOOSE BUSTERS, INC. LIMITS THE DURATION OF ANY IMPLIED WARRANTIES TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY. IF THE PRODUCT HAS BEEN PURCHASED FOR PURPOSES OTHER THAN CONSUMER USE AS DEFINED BY 15 U.S.C. § 2301, THEN THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL IMPLIED WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ALL EXPRESS WARRANTIES, WHETHER WRITTEN OR ORAL, AND OF ALL OTHER OBLIGATIONS OR LIABILITIES ON OUR PART. IF THE PRODUCT HAS BEEN PURCHASED FOR CONSUMER USE AS DEFINED BY 15 U.S.C. § 2301, THEN ANY IMPLIED WARRANTY OR WARRANTIES SHALL EXPIRE ON EXPIRATION OF THIS EXPRESS WARRANTY.  YOU HEREBY ACKNOWLEDGE THAT THE LIMITED WARRANTY PROVIDED HEREIN AND THE OBLIGATIONS AND LIABLITIES OF CHICAGOLANDS GOOSE BUSTERS, INC. ARE EXCLUSIVE AND YOU HEREBY WAIVE ALL OTHER REMEDIES, WARRANTIES, GUARANTEES OR LIABILITES, EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE, WHETHER OR NOT OCCASIONED BY NEGLIGENCE BY CHICAGOLANDS GOOSE BUSTERS, INC.. YOU ACKNOWLEDGE, BY YOUR USE OF THE PRODUCT, THAT YOUR USE OF THE PRODUCT AND ANY RELIEANCE UPON IT IS AT YOUR SOLE RISK, THAT YOU ASSUME FULL RESPONSIBLILTY FOR ALL COSTS ASSOCIATED WITH ALL DEPLOYMENT AREA MAINTENANCE AND NECESSARY SERVICING OR REPAIRS OF ANY EQUIPMENT YOU USE IN CONNECTION WITH THE PRODUCT.  CHICAGOLANDS GOOSE BUSTERS, INC. SHALL NOT BE HELD LIABLE FOR ANY LOSS TO YOU BASED ON DOWN TIME, SPOILAGE, LOST PRODUCTION OR LOST PROFITS.  IT IS THE INTENTION OF BOTH OF US THAT THIS PROVISION BE CONSTRUED BY THE COURT AS BEING THE BROADEST LIMITATION OF LIABILITY CONSISTANT WITH APPLICABLE LAW.  IN NO EVENT SHALL CHICAGOLANDS GOOSE BUSTERS, INC. BE LIABLE FOR DAMAGES WHICH EXCEED THE MONIES PAID BY YOU TO CHICAGOLANDS GOOSE BUSTERS, INC. FOR THE PRODUCT LESS THE VALUE OF THE BENEFITS RECEIVED BY YOU AND THE VALUE OF THE PRODUCT.
